EQUINE ACTIVITY RELEASE/INDEMNIFICATION/HOLD HARMLESS AGREEMENT
DEEP LM FARM, LLC, Karin Folkers & CLOUDCROFT, LLC
Under Ohio Law, an equine activity sponsor or equine professional is not liable for injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
1. I, the undersigned have read , understand, and with full knowledge voluntarily enter into this Release and Hold Harmless Agreement with DEEP LM FARM, LLC, Karin Folkers, CLOUDCROFT LLC, its owners, agents and assigns (hereinafter FARM/STABLE).
2. I understand the potential dangers that I could incur in mounting, riding, walking, cleaning, boarding, feeding or watering a horse; including, but not limited to, any interactions with other horses or persons. Understanding those risks I hereby release, indemnify and hold FARM/STABLE harmless from any liability whatsoever in the event of injury, damage of any nature, or death to me or anyone else caused by or incidental to my electing to mount and ride a horse owned or operated by STABLE.
3. I hereby acknowledge that I have familiarized myself with the activities that I will be participating in while on the premises of FARM/STABLE and recognize the inherent risks involved in riding and/or working with horses. Such risks included, but may not be limited to; bites or kicks from horses; being thrown or bucked off a horse; scratches or injury from stalls, fences or enclosures; allergic reactions to animals or hay; slipping, falling or otherwise being injured in the barn, stalls, or on the grounds of FARM/STABLE. I hereby specifically release FARM/STABLE from any liability for injury arising out of such risks.
4. I further voluntarily agree and warrant to release and hold FARM/STABLE harmless from any liability whatsoever, including, but not limited to, any incident caused by or related to FARM/STABLE’s negligence, relating to injuries known, unknown, or otherwise not herein disclosed. Such injuries may include injury, death or property damage from: mounting; riding; dismounting; walking; grooming; feeding; use of horse barn, arenas or trails; falling off a horse for any reason; or my failure to understand any equine professional’s directions relating to my riding, use and control, or lack thereof, of my horse or any horse I may elect to ride while on the premises.
